Hiring Agreement 2017

The client must commit/adhere to the hiring agreement as presented in this document in order to secure the use of the photobooth and any additional or associated equipment/services provided by Kiss and Tell Photobooths prior to the proposed date and time of the event. Any refusal to do so may result in the immediate cancellation of the clients booking and may incur the fee of the non-refundable deposit. By confirming your booking the client acknowledges that they’re are bound by these terms.

1. HIRING

1.1) A non refundable deposit of $300 is required in order to secure a client’s booking. This deposit is to be received by the hirer to confirm the booking prior to the event with full payment to be received no less than 3 weeks prior to the event. Failure to make full payment within this time period will result in forfeiture of the client’s deposit and

cancellation of the booking. Events booked at short notice will be subject to full non- refundable payment within 48hrs of the event time & date in order to secure the booking.

1.2) The client is responsible for any damage caused by the client or their guests to hired equipment for the duration of the agreed hire period. In the event that the photobooth/equipment is damaged, all costs associated with the repair or replacement will be paid for in full by the hiring client. The client may in addition remain liable for any hiring fees during the period of repair or unavailability of the photobooth/equipment due to loss, damage or theft while in the possession or control of the client.

2. CANCELLATION

2.1) Any and all booking cancellations will result in the deposit and subsequent payments by the client being retained in full by Kiss and Tell. Should the client wish to cancel an outstanding booking but wish to make an alternate booking, the deposit and subsequent payments may then be credited to the new booking provided the cancellation doesn’t occur within 10 days of the original booking. This is at the discretion of Kiss and Tell Photobooths who remain under no obligation to do so, however, will act reasonably when making any such determination.

3. RELEASE OF IMAGES

3.1) Unless otherwise mutually agreed by the parties in writing, the client grants to Kiss and Tell an irrevocable right and license to use and publish, in any and all media, any and all images including recorded material captured and produced by hired equipment during the agreed hire period for the purpose of Kiss and Tell Photobooths marketing and advertising. Kiss and Tell Photobooths will not use images or material which is deemed unsuitable on their website or social media page(s) or for any advertising purposes. Kiss and Tell will not use any content which it feels may be damaging to any person(s).

4. INDEMNITY

4.1) The client will be held solely responsible for the behavior of both themselves and their guests in regards to the appropriate, safe and responsible use of the photobooth/equipment while in use throughout the duration of the agreed hire period or up

until such time that the photobooth/equipment has been removed from the venue. Full risk in regards to the use of the photobooth/equipment will lie solely with the client.

4.2) The client accepts full responsibility for, and indemnifies Kiss and Tell Photobooths against all claims arising from the occurrence of any event beyond our reasonable control or in respect to any injury to persons, or damage to property, arising out of the use of the hired photobooth/equipment during the agreed hire period however arising.

5. DELIVERY & REMOVAL AND VENUE REQUIREMENTS

5.1) The delivery, set up, pack down and removal of the photobooth/equipment will be completed by Kiss and Tell Photobooths outside of the agreed hire period. Obtaining confirmation of the venues approval/consent to accommodate the photobooth/equipment, access to the venue and placement of the photobooth/equipment inside the venue are the sole responsibility of the client.

5.2) The client must ensure that the venue is able to meet the space and power requirements in order to successfully accommodate and operate the photobooth/equipment. Minimum space required to set up the photobooth is 2m wide x 2m long x 2.5m high. Access to a 240v power point/wall socket is required for operation.

5.3) Kiss and Tell Photobooths will not be held responsible for any resulting delay in service or impact on the client’s event arising from any of the above stated provisions not being met by the client. There will be no extension of the agreed hire time and no refund of payment, full or part thereof, due to any delay resulting from failure to meet the above stated provisions.

6. ATTENDANTS

6.1) We request that the Attendant is to be provided with a small supplier meal at all events over 4 hours in duration.

For us to be successful in this endeavour we ask the cooperation of you and your invited guests in demonstrating courtesy and respect for both our staff and our equipment for the duration of the hire period. In the unlikely event of abuse to our staff or equipment, we reserve the right to cease operation immediately with no refund available to the client.
