Hiring Agreement & Terms

Initial Payment, Fees and Cancellation Charges

An initial part payment of $300 is required to secure your booking. This can be paid automatically through our online booking system. The initial down payment you pay to secure your event is non-refundable, and reflects the work we put into events prior to attending, and the bookings we will have missed be securing your date for you. This includes any bookings cancelled due to any unforeseen restrictions that are put in place due to Covid-19, however will will happily move your booking over to a new date if you have to cancel for this reason, provided we have an availability.

The balance payment for the booking is due prior to the event date. Failure to make full payment within this time period will result in forfeiture of the client’s initial part payment and cancellation of the booking. Events booked at short notice will be subject to full non-refundable payment within 48hrs of the event time & date in order to secure the booking.

All cancellations must be made by contacting us. Once your event has been cancelled, your event date will immediately be available for other people to book. Any and all booking cancellations will result in all payments by the client being retained in full by Kiss and Tell.

Should the client wish to cancel an outstanding booking but wish to make an alternate booking, all payments may then be credited to the new booking provided the cancellation doesn’t occur within 10 days of the original booking. This is at the discretion of Kiss and Tell Photobooths who remain under no obligation to do so, however, will act reasonably when making any such determination.

Full Payment

You will be invoiced for the balance payment at 21 days before your event. The invoice will be generated and e-mailed to you.

Venue, Access, Location and Staff

It is your responsibility to ensure you have provided the venues contact information, address, name, and postcode for our setup team to find you. We also require that the venue allows reasonable access for loading (and suitable parking once the booth and equipment has been unloaded, this is only if you have added an attendant on to your booking. Please note – If no parking is provided by you and we are required to pay for parking the parking cost will be added to your account.)

If parking for loading is restricted you will be liable for any fines or parking costs that occur as a result and or time used seeking a suitable location. We cannot be held responsible for any errors or delays resulting from incorrect or missing address details.

Please be aware that we don’t provide an attendant or staff member present during your event unless you have added this on to your hire as an upgrade during the booking process. Our photo booths run exceptionally well on ‘auto-pilot’ and can be operated very easily by you and your guests. Although rarely necessary, our photobooths can be remotely connected to by us to resolve any issues that may present themselves.

Space Requirements

The photo booths require an area of 3.5m x 3.5m of floor space and a height of at least 3 metres for backdrops.

Props

Props are also not included with our packages by default, but can be added on as an extra using our booking form.

Events Beyond Our Control

Kiss and Tell Photobooths cannot be held responsible for any circumstances that may prevent us from attending your event; these may include but are not limited to, severe weather conditions, traffic delays, breakdown of our vehicles or equipment failure. In the case that we cannot attend or fulfil your hire due to events beyond our control we will contact you or the venue as soon as possible. In these instances our liability will be limited to the refunding all of monies paid.

Set-up Of Services

We will arrive to set up approximately 60 minutes before the hire period is due to commence. If you require the booth to be set up earlier an idle time charge applies.

It is your responsibility to ensure that the venue has agreed for us to be in attendance at their venue and at the agreed time. This also includes ensuring that there is access to enter the venue and enough space with a power socket within 3 metres of where the services are to be.

It is your responsibility to inform us of any circumstances that may make setting up take longer, these may include but are not exhaustive to; going upstairs, a long distance from unloading area to set-up area, restricted access. If we are not aware of these and the set-up takes longer than normal your hire period may be intruded into.

Unless otherwise agreed to in writing, your venue will need to allow us access to collect the photo booth equipment the following day.

Backdrops

Please note that backdrops need to be setup against a wall or solid surface at the venue/residence of your booking. This is to prevent the backdrop from being knoicked over, and to conceal the design on the opposite side of the backdrop as some of our stretch fabric backdrops have different designs on each side.

Hire Period

The hire period will be for a set period as specified in the booking form and as agreed by both parties before. Setup is typically 60 minutes and there is a 30 minute pack down time, these times are included in your package price and will not intrude into the agreed operational time of the photobooth. Use will commence at the agreed time and finish at the agreed time in the booking form unless due to technical difficulties on our behalf, when we provide the service for the set period once rectified.

If your event simply starts late or runs late, our period of hire will still be for the agreed period and times unless we agree to provide additional hours as per our additions.

If the booth is provided to you without an attendant at your event and a technical issue arrises, you are required to notify us by phone on 0435 443 424 so the issue can be resolved while the event is still occuring. No refund for services will be provided if we are notified of any problems after the event.

No Liability Is Accepted For:

Loss of or damage to property belonging to or travelling with the members of any group. For example watches, jewellery, cameras or clothing.

Personal injury or death of any participants however caused unless by proven negligence of Kiss and Tell Photobooths.

Termination Of Hire

Kiss and Tell Photobooths will not tolerate any abuse or threatening behaviour to our employees. If this occurs Kiss and Tell Photobooths retain the right to terminate the hire, with no refund payable for hire time that has been cut short. We are providing a service to you , our staff should be treated with the respect they deserve.

Kiss and Tell Photobooths also retain the right to terminate a hire if they feel that any equipment or property belonging to Kiss and Tell Photobooths is in danger of being damaged or has been damaged due to unruly behaviour from you. We also reserve the right to refuse guests to participate in the activities if we feel they are too unruly.

In any instances where we feel there is a need to terminate the hire we will attempt to speak with you or the hosting venue first, if possible to try to resolve the matter before termination.

You will be fully responsible for any damages caused by you or any other attendees at the event to the booth or booth equipment howsoever caused, with the sole exclusion of Kiss and Tell Photobooths staff.

The client accepts full responsibility for, and indemnifies Kiss and Tell Photobooths against all claims arising from the occurrence of any event beyond our reasonable control or in respect to any injury to persons, or damage to property, arising out of the use of the hired photobooth/equipment during the agreed hire period however arising.

Any damages must be reported to a member of Kiss and Tell Photobooths staff immediately.

Release Of Images

Unless otherwise mutually agreed by the parties in writing, the client grants to Kiss and Tell an irrevocable right and license to use and publish, in any and all media, any and all images including recorded material captured and produced by hired equipment during the agreed hire period for the purpose of Kiss and Tell Photobooths marketing and advertising. Kiss and Tell Photobooths will not use images or material which is deemed unsuitable on their website or social media page(s) or for any advertising purposes. Kiss and Tell will not use any content which it feels may be damaging to any person(s).

Digital Copy of Images

Please allow up to 10 days after your event to receive the digital copy of the photobooth photos. This will be delivered to you via download link that you will receive via email, the photos will also be available in your client portal. We recommend that you download your photos immediately after receiving the download link as they will only remain available for download for a period of 30 days.

We do not censor, edit or curate the gallery, or any individual photos, captured by the photobooth. If an image has been captured by the photobooth it will be sent through to the client as part of their digital gallery. It is up to the client to inform event attendees of acceptable and appropriate behaviour for their event, and also inform them that there will be digital copies viewable post event. We strongly recommend downloading the photo gallery from the link we provide you post event and curating the gallery yourself, before sending them on to 3rd parties.

Please note – Any outstanding invoices or payments on your account will need to be paid prior to us delivering the download link to the digital copy of the photos.

Booth Choice

Please be sure to understand the features of the booth you have chosen for your event. If the wrong booth preference is selected we are unable to provide an alternative booth option unless agreed upon prior to the day of the event.

Where possible we are happy to change the booth type, upon request, prior to the event if your new preference is available.

Please understand that the selfie booth and the social booth do not print physical copies of the photos, they take digital images only. These 2 booths allow guests to sms and email the digital copies of their images from the booth’s touch screen. The social booth package does not include props or a photo booth host.

All of our photobooths except the ‘Selfie booth’ use Canon DSLR cameras. Our selfie booth uses a webcam camera. While all effort is taken to achieve the best images and best quality photos possible during the event, our booths are designed to be event entertainment and do not replace a professional photographer, and we do not claim the images to be at the same standard of photo quality as a professional photographer. The resulting images we believe are excellent quality and above what is typically expected from a photobooth, examples can be seen on our gallery page on our website.

Print Design

Our client’s can choose from one of the print design templates in our catalogue and modify the colours and written details to suit their event’s theme. We only offer the print design choices in our catalogue, these can adjusted to include the client’s choice of written details and choice of colour, where the design allows.

If the client requires a different design to the print templates we offer, the complete design file will need to be provided in full to Kiss and Tell Photobooths as we don’t offer customised prints other than those in our own catalogue.

We typically prepare the design a few days before each event, and we can provide a mockup of the final design then if requested. We offer a maximum of 2 revisions on print designs.

For us to be successful in this endeavour we ask the cooperation of you and your invited guests in demonstrating courtesy and respect for both our staff and our equipment for the duration of the hire period. In the unlikely event of abuse to our staff or equipment, we reserve the right to cease operation immediately with no refund available to the client.
